Privacy Policy

Effective date: October 2, 2026

This Privacy Policy describes how Zack Kravits Inc., an Arizona corporation (“Company,” “we,” “us,” or “our”), collects, uses, discloses, and retains personal information when you use our websites, buy a product or program, join a membership such as Unplugged, apply for coaching, or otherwise interact with us. Zack Kravits is the Company’s founder and may deliver coaching. Purchases and accounts on our sites are with the Company.

This Policy applies to our sites, checkout, email and SMS programs, coaching calls, community spaces we host, and the service providers listed below. It does not apply to third-party sites we do not control, including Instagram, YouTube, and a payment page after you leave our checkout.

If this Policy conflicts with a signed agreement on confidentiality of coaching sessions, the signed agreement controls that engagement. Nothing in this Policy waives a non-waivable privacy right.

1. INFORMATION WE COLLECT

You provide:

  • Identity and contact data: name, email, phone, mailing address, social handles, and business name.
  • Account and application data: login details, application answers, goals, and messages you send us.
  • Transaction data: product purchased, price, payment plan, and the last four digits or token returned by our processor. We do not store full card numbers. Stripe, Kajabi Payments, or the processor shown at checkout collects and processes payment data.
  • Coaching and community data: information you share on a call, in a form, in a portal, or in a community space. Calls may be recorded as described in our Terms and Conditions.
  • Marketing preferences: email opt-in, SMS opt-in, and opt-out records.
  • Support records: emails, DMs you send us, and refund or guarantee requests.

Collected automatically:

  • Device and log data: IP address, browser, device type, approximate location derived from IP, pages viewed, and referring URL.
  • Cookie and pixel data: identifiers used by us and by analytics and advertising tools, including Google Analytics and the Meta Pixel, to measure traffic and, where enabled, to measure and deliver ads.
  • Usage of hosted platforms: Kajabi and similar portals log access to course pages and community features under their own terms.

We do not ask for government ID numbers, health records, or precise geolocation. Do not send us sensitive information we did not request. If you include it in an application or on a call, we will use it only to deliver the service you asked for and to meet a legal duty.

We do not knowingly collect personal information from anyone under 18. Our products are directed to adults. If we learn we have collected information from a child under 13, or from a minor who purchased a product, we will delete it. Contact [email protected].

2. HOW WE USE INFORMATION

We use personal information to:

  • Provide the product, membership, or coaching you bought, including access, scheduling, and support.
  • Take payment, manage a payment plan, and keep tax and accounting records.
  • Send transactional messages about your purchase, access, or a change to the terms you accepted.
  • Send marketing email or SMS if you opted in. You may unsubscribe from marketing email with the link in the message. Reply STOP to opt out of SMS. Consent to marketing texts is not a condition of purchase.
  • Measure site and ad performance, including through Google Analytics and the Meta Pixel.
  • Protect the community, investigate abuse or intellectual-property misuse, and enforce our Terms.
  • Comply with law, respond to lawful process, and establish or defend a legal claim.

We do not use your information to make a decision that produces a legal or similarly significant effect about you by automated means.

3. SMS AND PHONE

If you opt in to texts, we may send marketing or account messages to the number you provide. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help. Consent is limited to the program you joined. We do not sell SMS consent to a third party, and we do not use an autodialer to text you unless you gave prior express written consent for that program.

4. COOKIES, PIXELS, AND ADVERTISING

We use cookies and similar tools for:

  • Strictly necessary operation, such as checkout and login.
  • Analytics, including Google Analytics.
  • Advertising measurement and retargeting, including the Meta Pixel, where that tool is enabled on a page.

A cookie banner or browser setting can block some of these tools. Blocking a necessary cookie may break checkout or login.

If a page runs the Meta Pixel or a similar advertising tool, information such as page views, events, and identifiers can be sent to Meta and used for cross-context advertising and measurement. Under the California Consumer Privacy Act, as amended by the CPRA, that kind of disclosure can be a “sale” or “share” of personal information even though we do not exchange your name for money. Other state privacy laws treat targeted advertising similarly.

We do not sell personal information for money. We do disclose identifiers and event data to advertising partners for the purposes above when those tools are enabled.

You may opt out of sale, sharing, and targeted advertising by emailing [email protected] with the subject “Do not sell or share,” and by enabling a browser-based Global Privacy Control signal, which we will treat as a valid opt-out for the browser that sends it. You can also reject non-essential cookies in the banner where one is shown, and adjust ad settings at Meta and Google. An opt-out stops the going-forward disclosure we control. It does not delete information already received by a platform under its own policy.

5. HOW WE DISCLOSE INFORMATION

We disclose personal information to:

  • Service providers that host or support the business under contract, including Kajabi (course, community, and email), Notion (templates and dashboards you access), Stripe and Kajabi Payments (payments), ConvertKit / Kit (email), and Google (analytics and email delivery). They may use the information only to provide the service to us, except as their own terms allow them to act independently.
  • Advertising partners, including Meta, when a pixel or similar tool is enabled, as described above.
  • A buyer or successor in a financing, merger, or sale of the business, under a confidentiality duty.
  • Professional advisors, a collection agency, or a payment network, if needed to collect an unpaid balance or respond to a chargeback.
  • A government authority, court, or other party when required by law, to protect someone’s safety, or to establish or defend a claim.
  • Other participants, if you post in a community or on a group call. Do not post information you do not want other clients to see.

We do not authorize a service provider to use your coaching-session content for its own marketing.

6. RETENTION

We keep personal information for as long as your account or access is active, then for as long as needed for tax, accounting, dispute, and enforcement purposes. Transaction records are generally kept for seven years. Marketing contacts are kept until you unsubscribe or ask us to delete them, subject to a suppression record so we do not email or text you again. Call recordings are kept for the period stated at the time of the program, or for as long as we use them in a coaching library if you agreed to that use in the Terms or a signed agreement. We delete or de-identify information when we no longer need it, unless the law requires us to keep it.

7. SECURITY AND BREACHES

We use access controls, encrypted payment processing through our processors, and vendor platforms that offer encryption in transit. No method of transmission or storage is completely secure. You provide information at your own risk to that extent.

If we become aware of a security incident involving unencrypted personal information we own or license, we will investigate and, if Arizona law requires notice, notify affected Arizona residents within the time A.R.S. § 18-552 requires, generally 45 days after we determine a breach occurred, subject to a law-enforcement delay. A knowing and willful violation of that statute can be enforced under the Arizona Consumer Fraud Act. We will also give any notice another applicable breach law requires.

8. YOUR CHOICES AND RIGHTS

Regardless of where you live, you may email [email protected] to:

  • Access the personal information we hold about you.
  • Correct inaccurate information.
  • Delete information we are not required to keep.
  • Opt out of marketing email or SMS.
  • Opt out of sale, sharing, and targeted advertising, as described in Section 4.
  • Appeal a denial of a privacy request. We will respond to an appeal within 45 days.

We will verify your request by matching the email or details on the account. We will respond within 45 days, and we may extend that once by another 45 days if we tell you why. We will not discriminate against you for exercising a privacy right. An agent may submit a request with signed authority and proof of identity.

Residents of California, and of other states with a comprehensive privacy law, may have additional rights to know categories of personal information collected, sources, purposes, and recipients; to correct and delete; to opt out of sale, sharing, and targeted advertising; and to appeal. California residents may also limit the use of sensitive personal information. We do not use sensitive personal information to infer characteristics. We do not offer financial incentives for personal information.

Those state laws apply only if we meet that state’s threshold. We honor a verified request described above whether or not a threshold is met, except where a legal exception applies, including completing a transaction, security, legal compliance, or an existing legal claim.

9. COMMUNITY, COACHING, AND RECORDINGS

Coaching calls and group sessions may be recorded. Use of a recording is governed by our Terms and Conditions or the signed agreement for that program. Other clients may hear what you say on a group call. We keep non-public client information confidential as stated in those terms, except where disclosure is required by law or necessary to prevent a credible threat of harm.

10. THIRD-PARTY PLATFORMS

Kajabi, Notion, Stripe, ConvertKit / Kit, Google, Meta, Instagram, and YouTube have their own privacy policies. If you interact with us on Instagram or YouTube, that platform’s policy also applies. We are not responsible for a third party’s independent use of information it collects under its own terms.

11. INTERNATIONAL VISITORS

Our sites are directed to people in the United States. We do not intentionally offer products to residents of the European Economic Area, the United Kingdom, or Switzerland. If you contact us from outside the United States, your information will be processed in the United States, which may not provide the same protections as your country.

12. CHANGES

We may update this Policy by posting a new version with a new effective date. If we make a material change to how we use information already collected, we will send a notice to the email on the account or post a clear notice on the site before the change applies. Continued use after the effective date applies to information collected after that date.
